Terms of Use
These Terms of Use (“Terms”) are a contract between you and MakoFit (“MakoFit”, “we”, “our”, or “us”) covering your use of the MakoFit mobile and Apple Watch apps and the website at mako.fit (together, the “Service”). Please read them carefully. Your use of the Service means you accept these Terms.
1. Acceptance
By creating an account, downloading the app, or browsing mako.fit, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use MakoFit — or older where local law requires (for example 16 in parts of the EU). If you are under the age of majority in your country, you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.
You also confirm that you are physically fit to undertake the exercise activities you choose to log and that you have, where appropriate, consulted a qualified healthcare professional before beginning or changing an exercise programme. MakoFit is a logging and tracking tool, not a medical device and not a substitute for professional medical, fitness, or nutritional advice.
3. Account and access
- You sign in to MakoFit using a third-party single sign-on provider. You are responsible for keeping that account secure.
- You may use MakoFit on the devices you own or control, in line with the applicable app-store terms.
- You are responsible for all activity that takes place under your account. Notify us straight away via the contact page if you suspect unauthorised use.
- You may delete your account at any time from within the iOS app under Settings → Account → Delete account.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to infringe anyone else’s rights,
- attempt to gain unauthorised access to MakoFit accounts, servers, or data that does not belong to you,
- reverse engineer, decompile, or interfere with the Service except where local law expressly permits it,
- upload content that is unlawful, hateful, harassing, infringing, or that contains malware,
- use the Service to harvest data about other users,
- resell, sublicense, or commercially redistribute the Service or its content,
- use automated means (scrapers, bots) to access the Service in a way that imposes an unreasonable load.
We may suspend or terminate access if we reasonably believe you have broken these Terms or applicable law.
5. Health and safety
Exercise carries inherent risk. Suggested loads, RPE values, rest periods, routine recommendations, and any other insights produced by MakoFit are computed from the data you have logged and are provided “as is” for informational purposes only. They are not professional advice, not a training programme, and not a substitute for the judgement of a qualified coach or healthcare professional.
You alone decide what weights to lift, what exercises to perform, and when to stop. Stop immediately and seek medical attention if you feel faint, dizzy, short of breath, or experience pain.
By using the Service you accept full responsibility for your training and the risks associated with it. To the fullest extent permitted by law, MakoFit accepts no liability for any injury, illness, death, property damage, or other loss arising from your use of the Service or reliance on any insight it produces.
6. Your content
The workouts, routines, notes, avatar images, and any other content you create remain yours. You grant MakoFit a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and back up that content solely to operate, secure, and improve the Service for you. We do not use your workout data to train machine learning models, and we do not share it with third parties except as described in the Privacy Policy.
7. Subscriptions, purchases, and refunds
Parts of the Service may require a paid subscription or one-time purchase made through your device’s app store. The app store — not MakoFit — manages billing, renewals, taxes, and refunds for purchases. You can manage or cancel a subscription from your device’s app-store subscription settings.
Refunds are governed by the app store’s policies and any non-waivable statutory rights you have in your country. We are not able to issue refunds for app-store purchases directly.
8. Intellectual property
The MakoFit name, wordmark, app icons, website design, source code, exercise catalogue, and other materials we provide are owned by MakoFit or its licensors and are protected by copyright, trademark, and other laws. Except for the rights expressly granted in these Terms, no licence is given.
You receive a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial workout tracking.
9. Third-party services and connected clients
Platforms we run on
MakoFit relies on third-party platforms and infrastructure providers — including the operating system platforms our apps run on and our cloud backend. Your use of those platforms is also governed by their own terms and privacy policies, and we are not responsible for their content, availability, or practices.
Third-party clients you connect to your account
MakoFit exposes a Model Context Protocol (MCP) endpoint that lets you grant AI assistants and other third-party clients access to your MakoFit data via OAuth. You initiate and manage these connections from inside the iOS app, under Settings → AI Assistants.
- You choose which clients to connect and which scopes to grant. You are responsible for that choice and for reviewing the third party’s own terms and privacy policy before authorising it.
- We do not control, endorse, vet, or audit third-party clients. They are not our service, our agents, or our partners.
- Actions taken against MakoFit using a token you have granted — reading, writing, or deleting your MakoFit data through our API — are treated as your own actions for the purposes of these Terms.
- What the third-party client does with your data once it has received it — how it stores, retains, processes, transmits, trains models on, shows to other users, or otherwise uses that data — is entirely outside our control and outside these Terms. It is governed by the third party’s own policies, and any complaint about that handling must be raised with them.
- We have no liability for the availability, accuracy, security, or conduct of any third-party client, for any data loss or unauthorised disclosure caused by it, or for any consequences arising from your decision to connect it.
- You may revoke a third-party client at any time from Settings → AI Assistants. Revocation stops new API access; it does not delete copies of your data that the third party has already retrieved. To request deletion of those copies you must contact the third party directly.
10. Disclaimers
The Service — including the app, the website, the exercise catalogue, suggested loads, recovery and ramp suggestions, muscle-map insights, charts, summaries, and every other output — is provided “as is” and “as available”, with all faults, and without any warranty of any kind.
To the maximum extent permitted by law we disclaim every warranty, condition, and representation, whether express, implied, or statutory, including but not limited to warranties of fitness for a particular purpose, merchantability, accuracy, reliability, timeliness, completeness, quiet enjoyment, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, free of viruses, or that any data will not be lost or corrupted, and we do not warrant that any insight, recommendation, or value produced by the Service is correct, safe, or suitable for you. Backups are your responsibility; export your workout history regularly if you need a personal copy.
11. Limitation of liability
You use the Service entirely at your own risk. To the maximum extent permitted by law, MakoFit accepts no liability whatsoever in connection with the Service or any insight it produces, including for:
- any direct, indirect, incidental, special, consequential, exemplary, or punitive damages,
- loss of profits, revenue, savings, data, goodwill, or business opportunity,
- personal injury, illness, or property damage you suffer or cause,
- the acts or omissions of any third party,
- service interruptions, data loss, or inaccurate insights.
This applies even if we have been advised of the possibility of such loss.
Our total aggregate liability for any and all claims relating to the Service is limited to £0 (zero pounds). MakoFit does not carry, and is not required to carry, any insurance covering your use of the Service.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded (including your non-waivable statutory rights as a consumer). Where any part of this section is held unenforceable, the remaining provisions continue in force.
11a. Indemnity
You agree to indemnify and hold MakoFit harmless from any claim, loss, or expense (including reasonable legal fees) brought by a third party arising from your use of the Service, your content, your breach of these Terms, or your violation of any law or the rights of another person.
12. Termination
You may stop using the Service at any time by deleting your account. We may suspend or terminate your access if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will notify you in the app or by email before they take effect. Continued use of the Service after the changes take effect means you accept the updated Terms. The “Last updated” date at the top of this page always reflects the current version.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of these Terms, except that if you are a consumer resident in another country you may also bring proceedings in the courts of your country of residence, and you keep the benefit of any mandatory consumer protection rules that apply there.
